The Federal Constitutional Court rejected an election complaint in written proceedings. It stated that the complaint had no success for the reasons given in the rapporteur's letter of 22 February 2016 and, pursuant to § 26(3) sentence 3 EuWG in conjunction with § 24 sentence 2 BVerfGG, provided no further reasons.
§ 26 Abs. 3 S. 3 EuWG i.V.m. § 24 S. 2 BVerfGG; election complaint may be rejected without further reasons when the Court refers to the grounds set out in the rapporteur's letter. The Court may dispense with an extended statement of reasons if the complaint plainly lacks prospects of success and the statutory conditions for a summary dismissal are met.
