The Federal Constitutional Court did not accept a constitutional complaint against a Social Court order denying legal aid. It held that the complaint failed to satisfy the subsidiarity requirement because the applicant had not first used the hearing objection under § 178a SGG. Since the alleged violation could have been addressed in the specialized proceedings, the constitutional complaint was inadmissible.

This applies in particular if the alleged breach consists in the failure to give a procedural indication or hearing notice; the objection is a suitable and, as a rule, necessary preliminary remedy (consid. 1).

Nichtannahmebeschluss: Subsidiarität der Verfassungsbeschwerde bei unterbliebener Anhörungsrüge im fachgerichtlichen Verfahren (hier: gem § 178a SGG)
1 Die Verfassungsbeschwerde ist nicht zur Entscheidung anzunehmen (§ 93a Abs. 2 BVerfGG). Sie wahrt nicht den Grundsatz der Subsidiarität. Insbesondere ermöglicht es die Anhörungsrüge nach § 178a SGG, die geltend gemachten Grundrechtsverletzungen schon im fachgerichtlichen Verfahren zu verhindern oder zu beseitigen (vgl. hierzu BVerfGE 107, 395 <414>; 112, 50 <60>; 134, 106 <115 Rn. 27>). Hier hat das Sozialgericht die Bewilligung von Prozesskostenhilfe mit der Begründung abgelehnt, die vom Beschwerdeführer auf entsprechende Anforderung übersandten Unterlagen umfassten nicht den vorgegebenen Zeitraum. Für den Beschwerdeführer, der gegenüber dem Sozialgericht erklärt hatte, der Aufforderung (vollständig) nachgekommen zu sein, hätte es daher nahegelegen, sich wegen des Unterbleibens eines diesbezüglichen Hinweises zunächst im Rahmen einer Anhörungsrüge an das Sozialgericht zu wenden.
