No constitutional complaint by prevailing party

BVerfG 2 BvR 2274/13Bverfg / 2. Senat 1. Kammer28.09.2015Inadmissible

Omnilex-Zusammenfassung

The First Chamber of the Second Senate of the Federal Constitutional Court refused to admit the constitutional complaint. The complainants had been successful before the Federal Labour Court, and the Court held that they were therefore not personally burdened by the challenged judgment. For that reason, the complaint lacked admissibility under Section 90(1) BVerfGG and was dismissed without reasoning. The decision is final.

Omnilex-Regeste

§ 90 Abs. 1 BVerfGG; constitutional complaint by a party prevailing in the underlying proceedings; lack of present grievance. A constitutional complaint is admissible only if the complainant is personally, presently and directly affected by the challenged act. A merely favorable substantive decision of the specialised court does not create a constitutional grievance, even if the complainant contests the legal reasoning or ancillary considerations. A prevailing party is thus not entitled to seek constitutional review of the judgment itself for want of burden (consid. 1).

Kernrechtsfrage

Whether the constitutional complaint was admissible despite the complainants having prevailed in the underlying labour proceedings

Extrahierter Entscheid

The complaint was not admitted because the complainants were not adversely affected by the challenged Federal Labour Court judgment.

Extrahierte Begründung

A constitutional complaint requires present grievance under Section 90(1) BVerfGG; a party that prevailed in the merits proceedings is not burdened by a favorable judgment and therefore lacks standing to complain.
