Zusammenfassung

The Federal Constitutional Court did not admit the constitutional complaint. It held that, insofar as the complainant alleged a violation of fundamental rights by reference to the European Convention on Human Rights, he had not properly exhausted the legal remedies. The decision is final and non-appealable.

A mere reference to the ECHR does not dispense with the exhaustion requirement. If this prerequisite is lacking, the complaint is not admitted (consid. without reasons; tenor with reference to BVerfGE 112, 50 <62>; 129, 78 <93>).

BVerfGE 112, 50 <62>; 129, 78 <93>).

Diese Entscheidung ist unanfechtbar.
