The Federal Constitutional Court joined two constitutional complaint proceedings and then refused to accept them. It held that the complainants had not properly exhausted the legal process insofar as they based the alleged fundamental-rights violation on an asserted breach of the European Convention on Human Rights. The order is final and not subject to appeal.
§ 90 Abs. 2 S. 1 BVerfGG; constitutional complaint and exhaustion of remedies where the complaint is based on an alleged violation of the ECHR; a complainant must raise the convention-based grievance before the ordinary courts in a sufficiently specific manner. Failure to do so renders the constitutional complaint inadmissible. The Court may join parallel proceedings by order.

Die Verfassungsbeschwerden werden nicht zur Entscheidung angenommen; insbesondere haben die Beschwerdeführer, soweit sie sich zur Begründung einer behaupteten Grundrechtsverletzung auf einen Verstoß gegen die Europäische Menschenrechtskonvention berufen, den Rechtsweg nicht ordnungsgemäß erschöpft (vgl. BVerfGE 112, 50 <62>; 129, 78 <93>).
Diese Entscheidung ist unanfechtbar.
