The Federal Constitutional Court rejected the applicant's request for interim constitutional relief. It held that the subsidiarity principle applies equally to constitutional interim proceedings and that the applicant had not demonstrated exhaustion of available specialized interim remedies. The Court also noted that the application lacked a sufficiently concrete decisive factual basis. No further reasons were given under § 93d Abs. 1 sentence 3 BVerfGG.
§ 93d Abs. 1 Satz 3 BVerfGG; subsidiarity of constitutional interim relief; an application for an interim injunction is inadmissible if the applicant has not first exhausted available fachgerichtlicher Eilrechtsschutz. The principle of subsidiarity governing constitutional complaints applies mutatis mutandis to preliminary constitutional protection proceedings. The Constitutional Court may dispense with further reasoning where the legal situation is clear and no decision-relevant facts are sufficiently substantiated. Consideration 1 emphasizes that, absent exhaustion of ordinary remedies, constitutional interim relief cannot serve as a substitute for pending specialized judicial protection.

Ablehnung des Erlasses einer einstweiligen Anordnung wegen Subsidiarität
1 Der Grundsatz der Subsidiarität der Verfassungsbeschwerde (vgl. BVerfGE 102, 197 <207>) gilt auch für den vorgelagerten verfassungsrechtlichen Eilrechtsschutz (vgl. BVerfG, Beschluss der 3. Kammer des Zweiten Senats vom 9. Dezember 2009 - 2 BvQ 84/09 -, juris; BVerfG, Beschluss der 2. Kammer des Zweiten Senats vom 30. Dezember 2002 - 2 BvQ 59/02 -, juris). Unabhängig davon, dass sich dem Antrag über den Umstand hinaus, dass der Antragsteller zwangsbehandelt wird, bereits kein entscheidungserheblicher Sachverhalt entnehmen lässt, ist der Antrag danach unzulässig, da nicht ersichtlich ist, dass der Antragsteller, wie es ihm obliegt, zuvor die Möglichkeit fachgerichtlichen Eilrechtsschutzes ausgeschöpft hätte.
2 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.
