No continuing legal interest after case became moot

BVerfG 2 BvR 69/11Bverfg / 2. Senat 3. Kammer24.03.2011Inadmissible

Zusammenfassung

The Federal Constitutional Court declined to admit the constitutional complaint. It held that the OLG Nürnberg’s denial of a continuing legal interest after the underlying matter had been resolved did not violate the Constitution. The complainant had not shown any indication of abusive conduct by the prison administration that could justify a different assessment of legal interest. The complaint therefore lacked both fundamental significance and the need for enforcement-oriented review.

Regest

§ 93a Abs. 2 BVerfGG; § 115 Abs. 3 StVollzG; constitutional complaint after mootness and continuing legal interest: A constitutional complaint is not to be admitted where it neither raises questions of fundamental constitutional importance nor is necessary for the enforcement of fundamental rights. A refusal to recognize a continuing legal interest after the underlying dispute has become moot does not violate constitutional law if no specific indications of abusive conduct by the prison administration are shown. Mere dissatisfaction with the termination of proceedings is insufficient; a constitutional review requires concrete, substantiated reasons suggesting that a departure from the general rule on mootness is warranted.

Titelzeile

Nichtannahmebeschluss: Kein fortbestehendes Rechtsschutzinteresse iSd § 115 Abs 3 StVollzG
