In a constitutional complaint concerning the enforced toleration of examinations in proceedings to establish paternity, the Federal Constitutional Court repeated its interim order of 1 February 2012. The enforcement suspension was extended for another six months, but no longer than until the Court decides the constitutional complaint. The decision preserves the status quo pending the main proceedings.
Art. 6 Abs. 2 S. 1 GG; § 32 Abs. 1, Abs. 6 S. 2 BVerfGG: An interim order may be repeated where the continuation of provisional protection remains necessary pending the constitutional complaint. The court may extend a previously granted suspension of enforcement for a further limited period if the balancing of consequences still favors maintaining the status quo until the main case is decided. In paternity-related examination proceedings, the temporary protection concerns the enforceability of an obligation to tolerate investigative measures and may be maintained by repeated interim order (cf. operative part).
