The Federal Constitutional Court amended its earlier legal-aid order of 30 May 2011. Instead of attorney Dr. L., attorney Dr. H. was appointed as counsel for the applicant. The amendment was expressly limited so that no higher costs may arise for the public treasury.
§ 22 Abs. 1 S. 1 BVerfGG, § 114 S. 1 ZPO, § 121 Abs. 2 ZPO; substitution of appointed counsel in legal aid proceedings: An existing PKH appointment may be amended and another lawyer appointed in place of prior counsel, provided the statutory requirements for legal aid representation remain satisfied and the change does not entail higher costs for the state treasury. The decisive point is the continuity of the legal-aid mandate; the court may adjust the person of counsel without altering the scope of state financial burden (cf. consid. 1).

Abänderung einer PKH-Bewilligung: Beiordnung eines anderen Rechtsanwalts
Der Prozesskostenhilfebeschluss vom 30. Mai 2011 wird dahingehend geändert, dass an Stelle von Rechtsanwalt Dr. L. nunmehr Rechtsanwalt Dr. H. beigeordnet wird.
Die Abänderung der Beiordnung erfolgt mit der Maßgabe, dass hierdurch für die Staatskasse keine höheren Kosten entstehen.
