The Federal Constitutional Court repeated its earlier interim order in favor of an Afghan asylum applicant challenging deportation to Greece. The provisional protection against removal was extended for six months, but no longer than until the constitutional complaint is decided. The decision is final and not open to appeal.
§ 32 Abs. 1 BVerfGG; interim constitutional protection may be repeated or extended where necessary to avert serious disadvantages pending the main proceedings. The measure is limited in time and by the duration of the constitutional complaint proceedings; the Court may preserve the status quo by maintaining a stay of removal. In interim relief proceedings, the balancing of consequences is decisive, and the order is confined to what is indispensable for effective preliminary protection (consid. implied by tenor).
