Gründe

1 Die Verfassungsbeschwerde ist bereits unzulässig, weil der Grundsatz der Subsidiarität nicht gewahrt ist. Dieser verlangt vom Beschwerdeführer, über das Erfordernis der Rechtswegerschöpfung im engeren Sinn hinaus alle ihm zumutbaren, nach Lage der Dinge zur Verfügung stehenden prozessualen Möglichkeiten zu ergreifen, um Rechtsschutz bereits durch die Fachgerichte zu erreichen (vgl. BVerfGE 107, 257 <267>; 110, 1 <12>; stRspr).

2 Der Beschwerdeführer trägt nicht vor, ob er den vom Bundesverwaltungsgericht vorgezeichneten Weg beschritten hat, nachträglich einen Antrag nach § 12 Abs. 2 der Beihilfevorschriften des Bundes (BhV) in der damals geltenden Fassung zu stellen und auf diesem Weg eine Kostenerstattung herbeizuführen. Zugleich lässt sich seinen Ausführungen aber auch nicht entnehmen, dass beziehungsweise warum er diese Vorgehensweise für nicht zielführend hält. Vielmehr erschöpft sich sein Vorbringen in der pauschalen Behauptung, dass der grundsätzliche Ausschluss nicht verschreibungspflichtiger Medikamente von der Beihilfefähigkeit verfassungswidrig sei. Damit genügt die Verfassungsbeschwerde zugleich nicht den gemäß § 23 Abs. 1 Satz 2, § 92 BVerfGG an sie zu stellenden Substantiierungsanforderungen.

3 Von einer weiteren Begründung wird nach § 93d Abs. 1 Satz 3 BVerfGG abgesehen.

4 Diese Entscheidung ist unanfechtbar.
