The Federal Constitutional Court renewed its earlier interim order in favor of an Iraqi asylum applicant. The transfer to Greece under the Dublin system remained prohibited for six more months, or until the constitutional complaint is decided. The decision is a further temporary safeguarding measure and does not finally resolve the merits of the constitutional complaint.
§ 32 Abs. 1, Abs. 6 S. 2 BVerfGG; renewal of an interim injunction: An interim order may be repeated where the reasons for temporary protection continue to exist and the effectiveness of the pending constitutional complaint would otherwise be jeopardized by imminent, potentially irreversible consequences. In transfer cases under the Dublin system, temporary relief may be extended if the court considers continued safeguarding necessary until the constitutional complaint is decided.
