The Federal Constitutional Court repeated its earlier interim order barring the deportation of an Iraqi asylum applicant to Greece. The previous injunction of 9 October 2009 was extended for a further six months, but no longer than until the constitutional complaint is decided. The decision is limited to interim relief and contains no further substantive assessment in the tenor.
§ 32 Abs. 1, Abs. 6 S. 2 BVerfGG; repetition of an interim injunction: An interim order may be repeated and extended where the need for provisional protection persists. The Court may limit the extension to a fixed period or until the main constitutional complaint is decided; the order remains strictly provisional and does not prejudge the merits.
