Nichtzulassungsbeschwerde - Aufhebung der Entscheidung über die Auferlegung von Mutwillenskosten

Tenor

Der Antrag der Klägerin, die Entscheidung über die Auferlegung von Mutwillenskosten im Urteil des Bayerischen Landessozialgerichts vom 21. Juli 2010 aufzuheben, wird als unzulässig verworfen.

Die Beteiligten haben einander keine Kosten zu erstatten.

Gründe

1 Mit Urteil vom 21.7.2010 hat das Bayerische LSG einen Anspruch der Klägerin auf Gewährung von Rente wegen verminderter Erwerbsfähigkeit verneint und ihr gleichzeitig Mutwillenskosten in Höhe von 500 Euro auferlegt.

2 Mit Schriftsatz vom 3.9.2010 - beim BSG eingegangen am 7.9.2010 - hat die Klägerin beantragt, die Entscheidung über die Auferlegung von Mutwillenskosten iS von § 192 Abs 1 SGG aufzuheben.

3 Der Antrag ist unzulässig, sodass er entsprechend § 160a Abs 4 Satz 1 iVm § 169 SGG zu verwerfen ist.

4 § 192 Abs 3 Satz 2 SGG, auf den die Klägerin ihren Antrag offensichtlich stützen will, ist ausweislich Satz 1 dieses Absatzes nur anwendbar, wenn die Klage zurückgenommen worden ist. Eine im Urteil getroffene Kostenentscheidung ist nicht gesondert anfechtbar (BSG SozR Nr 2 zu § 192) , so dass auch eine Umdeutung des Antrags in einen zulässigen Rechtsbehelf ausscheidet.

5 Die Kostenentscheidung beruht auf einer entsprechenden Anwendung des § 193 Abs 1 SGG.
