Zusammenfassung

The Federal Court of Justice rejected the plaintiffs' non-admission complaint in a consumer loan case. It held that the matter had no fundamental importance and that neither development of the law nor uniformity of case law required a revision. The Senate also examined the prospects of success of a revision and found none. In particular, it saw no reason to challenge the appellate court’s view that § 355(2) sentence 1 BGB, in its former version, is satisfied when co-borrowers obtain joint possession of a written withdrawal notice. The plaintiffs were ordered to bear the costs of the complaint proceedings.

Die Nichtzulassungsbeschwerde der Kläger gegen den Beschluss des 3. Zivilsenats des Oberlandesgerichts Celle vom 18. Mai 2016 wird zurückgewiesen, weil die Rechtssache keine grundsätzliche Bedeutung hat und die Fortbildung des Rechts sowie die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts nicht erfordern (§ 543 Abs. 2 Satz 1 ZPO). Dabei hat der Senat die Erfolgsaussichten einer Revision geprüft und verneint (vgl. BVerfGK 6, 79, 81 ff.; 18, 105, 111 f.; 19, 467, 475). Das gilt auch, soweit das Berufungsgericht richtig davon ausgegangen ist, den Voraussetzungen des § 355 Abs. 2 Satz 1 BGB in der bis zum 10. Juni 2010 geltenden Fassung sei genügt, wenn Mitdarlehensnehmer Mitbesitz an einer in Textform erteilten Widerrufsbelehrung erlangten (OLG Frankfurt/Main, Beschluss vom 13. Januar 2016 - 23 U 42/15, juris Rn. 25 ff.; OLG Hamm, WM 2016, 116, 122 f.; Bülow, WuB 2016, 207, 210; Martis/Meinhof, MDR 2004, 4, 6; MünchKommBGB/Fritsche, 7. Aufl., § 355 Rn. 30 Fn. 48; Staudinger/Kaiser, BGB, Neubearb. 2012, § 355 Rn. 55; aA Knops/Martens, WM 2015, 2025, 2027 f.). Von einer weiteren Begründung wird gemäß § 544 Abs. 4 Satz 2 Halbsatz 2 ZPO abgesehen.

Die Kläger tragen die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).

Der Gegenstandswert des Beschwerdeverfahrens beträgt bis 45.000 €.
