Tenor

Die beabsichtigte Entscheidung des anfragenden 5. Strafsenats widerspricht nicht der Rechtsprechung des Senats.

Gründe

1 Der 5. Strafsenat beabsichtigt zu entscheiden:

2 Aus der Europäischen Konvention zum Schutz der Menschenrechte und Grundfreiheiten in ihrer Auslegung durch den Europäischen Gerichtshof für Menschenrechte ergibt sich für die Maßregel der Unterbringung in der Sicherungsverwahrung keine die Rückwirkung generell hindernde andere Bestimmung im Sinne des § 2 Abs. 6 StGB.

3 Er hat daher beim 4. Strafsenat angefragt, ob an entgegenstehender Rechtsprechung festgehalten wird, bei den anderen Strafsenaten, ob dieser Rechtsauffassung zugestimmt wird.

4 Die beabsichtigte Entscheidung widerspricht nicht der Rechtsprechung des Senats. Er stimmt der Rechtsauffassung des 5. Strafsenats zu.

5 Ob die Konvention eine einschränkende Auslegung des § 67d Abs. 3 Satz 1 StGB erfordert und gegebenenfalls in welchem Umfang lässt der Senat offen.
