Tenor

Die Anhörungsrüge gegen den Senatsbeschluss vom 27. Februar 2013 wird auf Kosten des Klägers zurückgewiesen.

Gründe

1 Die gemäß § 321a Abs. 1 ZPO statthafte Anhörungsrüge des Klägers ist nicht begründet.

2 Nach der vom Bundesverfassungsgericht gebilligten Rechtsprechung des Bundesgerichtshofs können mit der Anhörungsrüge nur neue und eigenständige Verletzungen des Art. 103 Abs. 1 GG durch das Rechtsmittelgericht gerügt werden (vgl. BGH, Beschlüsse vom 27. November 2007 - VI ZR 38/07, NJW 2008, 923 Rn. 5; vom 12. Mai 2010 aaO; BVerfG, Beschluss vom 5. Mai 2008 - 1 BvR 562/08, NJW 2008, 2635, 2636). Derartige selbständige Verstöße des Senats gegen Art. 103 Abs. 1 GG sind nicht ersichtlich.

3 Zwar weist der Kläger zutreffend darauf hin, dass die grundsätzliche Bedeutung der Sache im Zeitpunkt der Einlegung der Nichtzulassungsbeschwerde noch gegeben war, weil eine im Rechtsstreit entscheidungserhebliche klärungsbedürftige Rechtsfrage erst durch das Senatsurteil vom 20. Juni 2012 (IV ZR 39/11, VersR 2012, 1113) geklärt worden ist, sowie darauf, dass die Revision bei einem nachträglichen Wegfall der Grundsatzbedeutung gleichwohl zuzulassen ist, wenn sie im Ergebnis Aussicht auf Erfolg hat (Senatsbeschluss vom 27. Oktober 2004 - IV ZR 386/02, VersR 2005, 809 unter II 2).

4 Die letztere Voraussetzung ist im Streitfall indes nicht erfüllt. Der Kläger kann - was der Senat bei seiner Entscheidung vom 27. Februar 2013 geprüft hat - auch in der Sache nicht durchdringen.
