Zusammenfassung

The Federal Labour Court allowed the employee's revision, set aside the judgment of the Higher Labour Court and amended the Labour Court's judgment. Tenor

  1. Auf die Revision der Klägerin wird das Urteil des Landesarbeitsgerichts Schleswig-Holstein vom 13. Oktober 2015 - 1 Sa 130/15 - aufgehoben.

  2. Auf die Berufung der Klägerin wird das Urteil des Arbeitsgerichts Kiel vom 19. März 2015 - 5 Ca 2124 a/14 - abgeändert.

  3. Es wird festgestellt, dass der Klägerin aus dem Jahr 2014 noch zwei Urlaubstage als Ersatzurlaub zustehen und dass ihr über 28 Urlaubstage hinaus jährlich zwei weitere Urlaubstage zustehen.

  4. Die Beklagte hat die Kosten des Rechtsstreits zu tragen.

Sonstige Leitsätze
