  1. Auf die Revision des Beklagten wird das Urteil des Hessischen Landesarbeitsgerichts vom 2. März 2012 - 3 Sa 954/11 - aufgehoben.

  2. Auf die Berufung des Beklagten wird das Urteil des Arbeitsgerichts Kassel vom 26. Mai 2011 - 3 Ca 15/11 - abgeändert:

Die Klage wird als unzulässig abgewiesen.

  1. Die Kosten des Rechtsstreits hat die Klägerin zu tragen.
