Zusammenfassung

The Federal Labor Court dismissed the plaintiff’s revision against the judgment of the Hessian Labor Court. The parties had waived a statement of facts and reasons because of a parallel case. The only operative consequences were dismissal of the revision and allocation of the revision costs to the plaintiff.

§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1 ZPO, § 313a Abs. 1 Satz 2 ZPO; in revision proceedings the court may dispense with statement of facts and reasons where the parties have waived them, in particular in view of a parallel case. If the revision is unsuccessful, the revising party bears the costs of the revision.

Tenor

  1. Die Revision des Klägers gegen das Urteil des Hessischen Landesarbeitsgerichts vom 19. November 2012 - 17 Sa 292/12 - wird zurückgewiesen.
