Tenor

Auf die Revision der Klägerin wird das Urteil des Sächsischen Landesarbeitsgerichts vom 18. Januar 2012 - 2 Sa 225/11 - aufgehoben.

Auf die Berufung der Klägerin wird das Urteil des Arbeitsgerichts Bautzen vom 23. Februar 2011 - 1 Ca 1291/10 - abgeändert.

Es wird festgestellt, dass das zwischen den Parteien bestehende Arbeitsverhältnis nicht aufgrund der Befristung vom 5. Oktober 2006 zum 31. Dezember 2010 beendet worden ist.

Der Beklagte hat die Kosten des Rechtsstreits zu tragen.
