Zusammenfassung

The Federal Labour Court dismissed the defendant's revision against the judgment of the Berlin-Brandenburg Higher Labour Court. The parties had waived findings of fact and reasons under Section 313a ZPO. The only express operative part is that the defendant must bear the costs of the revision.

§ 313a ZPO; waiver of findings of fact and reasons does not preclude a judgment in revision proceedings. Where the court disposes of the revision without a full statement of reasons, the operative effect is limited to the rejection of the remedy and the incidental cost order; the losing revising party bears the costs of the revision.
