Validity of dismissal of the plaintiff’s employment

BAG 6 AZR 759/11Bag / 6. Abteilung13.12.2012Modified

Omnilex-Zusammenfassung

The plaintiff appealed a labour-law dismissal judgment concerning a termination dated 24 December 2009. The Federal Labour Court set aside the appellate judgment insofar as it had rejected the appeal against defendant 1 and amended the first-instance judgment to declare that the employment relationship with defendant 1 was not terminated by the dismissal. Costs were allocated between the parties for the lower instances, while defendant 1 had to bear the costs of the revision; defendant 3’s out-of-court costs were charged to the plaintiff. The decision contains no substantive reasoning because the parties waived findings of fact and reasons under § 313a ZPO.

Omnilex-Regeste

§ 313a ZPO; waiver of findings of fact and reasons; appeal against dismissal judgment. Where the parties waive the statement of facts and reasons, the judgment contains no substantive grounds. In revision, the Federal Labour Court may set aside the appellate judgment and amend the first-instance judgment if the dismissal is found not to have terminated the employment relationship. Cost allocation follows the respective degree of success in the proceedings; a respondent’s extra-judicial costs may be charged to the losing party, and revision costs may be imposed on the unsuccessful respondent.
