Zusammenfassung

The Federal Labour Court allowed the plaintiff's revision in part. It set aside the Hessian LAG judgment insofar as that court had rejected the plaintiff's appeal against defendant no. 1. On the merits, the Court granted the requested declaration that the employment relationship between the plaintiff and defendant no. 1 was not terminated by the notice of 15 January 2010. It also decided on a detailed apportionment of court and extrajudicial costs across the first, second, and revision instances, including the plaintiff's obligation to bear defendant no. 3's costs.

Employment termination challenge; declaratory relief concerning a notice of termination. Where the revision is successful only in relation to one respondent, the appellate judgment is to be set aside only to that extent and the first-instance judgment modified accordingly. The dispositive part may allocate court costs and extrajudicial costs separately by instance and by party, including cost liability of a non-successful co-defendant. If the decision is rendered without reasons, this does not affect the binding force of the dispositive part; the waiver of findings and reasons under § 313a ZPO is permissible.

Tenor

  1. Auf die Revision des Klägers wird das Urteil des Hessischen Landesarbeitsgerichts vom 25. Juli 2011 - 17 Sa 116/11 - aufgehoben, soweit es die Berufung des Klägers betreffend die Beklagte zu 1. zurückgewiesen hat.

  2. Auf die Berufung des Klägers wird das Urteil des Arbeitsgerichts Frankfurt am Main vom 10. November 2010 - 2 Ca 754/10 - teilweise abgeändert:

Es wird festgestellt, dass das Arbeitsverhältnis zwischen dem Kläger und der Beklagten zu 1. durch die Kündigung vom 15. Januar 2010 nicht aufgelöst worden ist.

  1. Die Gerichtskosten und die außergerichtlichen Kosten des Klägers in erster Instanz hat der Kläger zu 2/5 und die Beklagte zu 1. zu 3/5, in zweiter Instanz der Kläger zu 1/4 und die Beklagte zu 1. zu 3/4 zu tragen. Die außergerichtlichen Kosten der Beklagten zu 3. in erster und zweiter Instanz hat der Kläger zu tragen. Die Beklagte zu 1. trägt ihre außergerichtlichen Kosten erster und zweiter Instanz selbst.

  2. Die Beklagte zu 1. hat die Kosten der Revision zu tragen.
