Zusammenfassung

The Federal Labour Court dismissed the defendant's revision against the judgment of the Landesarbeitsgericht Berlin-Brandenburg. The lower-court judgment therefore remained unchanged. The court also ordered the defendant to bear the costs of the revision proceedings. The parties had waived the statement of facts and reasons under Section 313a ZPO.

§ 313a ZPO; where the parties waive findings of fact and reasons, the Federal Labour Court may decide without a full written justification. A revision that does not succeed is to be dismissed, and the costs of the revision are to be borne by the unsuccessful appellant under the general cost rule.
