Auf die Berufung des Beklagten wird das Urteil des Arbeitsgerichts Mannheim vom 13. Januar 2010 - 13 Ca 64/09 - abgeändert und die Klage abgewiesen.
Die Klägerin hat die Kosten des Rechtsstreits zu tragen.
