Revision succeeds; appeal dismissed in labor pay dispute

BAG 4 AZR 207/10Bag / 4. Abteilung16.11.2011Modified

Zusammenfassung

The Federal Labor Court heard the defendant's revision in a labor dispute and set aside the Hamm State Labor Court's judgment. The employee's appeal against the Hagen Labor Court's decision was dismissed. The court issued no factual findings or reasoning because the parties had waived them in view of a parallel case. The plaintiff was ordered to bear the costs of the appeal and revision.

Regest

§ 72 Abs. 5 ArbGG, § 555 Abs. 1 Satz 1, § 313a Abs. 1 Satz 2 ZPO; waiver of findings of fact and reasons in revision proceedings. If the parties validly waive the statement of facts and reasons, the Federal Labor Court may decide without setting out the factual findings or reasoning, particularly where reference is made to a parallel proceeding. The dispositive part then governs the procedural result and costs allocation; the absence of a written reasoning does not affect the effectiveness of the judgment.
