The Federal Labour Court dismissed the plaintiff's revision against the judgment of the Baden-Württemberg Labour Court of Appeal. The court issued the decision without a statement of facts or reasons under § 313a(1) ZPO. The plaintiff was ordered to bear the costs of the revision proceedings.
§ 313a Abs. 1 ZPO; dismissal of a revision without statement of facts and reasons: where the court dispenses with the written grounds under the statutory conditions, the judgment may be limited to the dispositive part and a short reference to the legal basis. If the revision is unfounded, it is dismissed and the unsuccessful appellant bears the costs of the proceedings.
