The Federal Labour Court dismissed the defendant’s revision with a modification of the lower-court judgments. It held that the claimant is entitled to a monthly performance bonus for the period from 1 July 2007 to 31 August 2008 in the total amount of EUR 237.02 gross, less any payments already made. The bonus must also be taken into account when calculating continued remuneration, additional holiday pay, and the 13th-month payment. The defendant was ordered to bear the costs of the revision. The parties waived findings of fact and reasons.

Where the parties waive findings of fact and reasons under § 313a ZPO, the appellate court may nevertheless uphold a claim for bonus payment if the remuneration component forms part of the calculation basis for wage continuation and ancillary remuneration entitlements. The decisive point is whether the bonus is remuneration-related and therefore to be included in the relevant pay base; if so, the employer must pay it for the determined period, subject to deduction of amounts already paid, and bear the revision costs when the appeal fails.

Die Beklagte ist verpflichtet, der Klägerin für die Zeit vom 1. Juli 2007 bis zum 31. August 2008 eine monatliche Leistungszulage in einer Gesamthöhe von 237,02 Euro brutto abzüglich bereits geleisteter Zahlungen zu zahlen und diese Leistungszulage bei der Berechnung des weiterzuzahlenden Monatsentgelts (§ 16 EMTV) , des zusätzlichen Urlaubsgelds (§ 14 Nr. 1 und Nr. 2 EMTV) sowie der Sonderzahlung (§ 2 Nr. 2.2 ETV 13. Monatseinkommen) zu berücksichtigen.
