The Federal Labour Court dismissed the employer's revision in an employment dispute over a performance allowance. Wird eine Leistungszulage arbeitsvertraglich bzw. kollektivvertraglich geschuldet, ist sie bei den hiervon abhängigen Entgeltbestandteilen zu berücksichtigen, soweit der einschlägige Tarifvertrag dies vorsieht. Das Revisionsgericht kann die Vorentscheidungen teilweise aufheben und den Tenor zur betragsmäßigen Bestimmung und zur Klarstellung der Berechnungsgrundlagen anpassen (consid. tenor).

Die Beklagte ist verpflichtet, dem Kläger für die Zeit vom 1. Juli 2007 bis zum 31. August 2008 eine monatliche Leistungszulage in einer Gesamthöhe von 552,67 Euro brutto abzüglich bereits geleisteter Zahlungen zu zahlen und diese Leistungszulage bei der Berechnung des weiterzuzahlenden Monatsentgelts (§ 16 EMTV) , des zusätzlichen Urlaubsgelds (§ 14 Nr. 1 und Nr. 2 EMTV) sowie der Sonderzahlung (§ 2 Nr. 2.2 ETV 13. Monatseinkommen) zu berücksichtigen.
