The Federal Court of Justice dismissed the defendant’s revision against the Darmstadt Regional Court judgment. The appeal argued a violation of the immediacy principle because an extraction report documenting deleted mobile phone/SIM data was read without hearing the expert who had created it. The court held that § 250 StPO is not violated where a specialist uses software to recover deleted data that would otherwise not be obtainable and only the extraction report and the recovered data are read. The revision revealed no legal error to the defendant’s detriment; the defendant was also ordered to pay the costs of the remedy.
§ 250 StPO; reading of an extraction report documenting deleted mobile phone or SIM data obtained with software; no violation of the immediacy principle if the expert is not personally examined. Where an expert uses a technical application to recover deleted data that would otherwise not be ascertainable, the report documenting the extraction and the individual data thus found may be introduced by reading; the evidentiary object is the recovered data, not the expert's oral explanation (consid. supplementary remarks). In such a constellation, personal examination of the expert is not required by § 250 StPO.

Verfahrensrüge der Verletzung des Unmittelbarkeitsgrundsatzes: Verlesung eines gelöschte Handydaten dokumentierenden Berichts ohne persönliche Vernehmung des verfassenden Sachverständigen
Die Revision des Angeklagten gegen das Urteil des Landgerichts Darmstadt vom 12. Mai 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat.
Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.
Ergänzend bemerkt der Senat:
Liest ein Sachverständiger mit Hilfe eines Anwendungsprogramms (gelöschte) Daten aus einem Handy oder einer SIM-Karte aus die ansonsten nicht zu ermitteln gewesen wären, verstößt die Verlesung allein des die Datengewinnung dokumentierenden Extraktionsberichts und der einzelnen aufgefundenen Daten nicht gegen den Unmittelbarkeitsgrundsatz (§ 250 StPO), auch wenn der Sachverständige selbst nicht angehört worden ist (vgl. Meyer-Goßner/Schmitt, StPO, 59. Aufl., § 250 Rn. 10).
