Tenor

  1. Auf die Revision des Angeklagten wird das Urteil des Landgerichts Bayreuth vom 16. September 2015 im Strafausspruch aufgehoben.

  2. Die weitergehende Revision wird als unbegründet verworfen.

  3. Die Sache wird im Umfang der Aufhebung zu neuer Verhandlung und Entscheidung, auch über die Kosten des Rechtsmittels, an eine andere als Schwurgericht zuständige Strafkammer des Landgerichts zurückverwiesen.

Gründe

1 Das Landgericht hat den Angeklagten wegen Bedrohung in zwei tatmehrheitlichen Fällen in Tatmehrheit mit versuchtem Mord in vier tateinheitlichen Fällen in Tateinheit mit besonders schwerer Brandstiftung zu einer Gesamtfreiheitsstrafe von neun Jahren und zwei Monaten verurteilt. Die auf die Verletzung formellen und materiellen Rechts gestützte Revision des Angeklagten hat mit der Sachrüge Erfolg.

2 1. Der Strafausspruch hält sachlich-rechtlicher Überprüfung nicht stand. Zwar mag die Wertung der Strafkammer rechtlich noch vertretbar sein, dem Angeklagten wegen der Nähe zur Tatvollendung eine Versuchsmilderung nach § 23 Abs. 2, § 49 Abs. 1 StGB zu versagen. Soweit die Strafkammer vor dem Hintergrund dieser getroffenen Strafrahmenwahl allerdings zu Lasten des Angeklagten berücksichtigt, dass die Gesundheit der im Haus schlafenden Personen erheblich gefährdet gewesen sei, ist diese Erwägung nicht rechtsfehlerfrei.

3 Das Landgericht lässt dabei unberücksichtigt, dass der Strafzumessung der – über § 21 StGB gemilderte – gesetzliche Normalstrafrahmen für eine vollendete Tatbegehung nach § 211 StGB zugrunde liegt. Innerhalb dieses Strafrahmens neuerlich die Erfolgsnähe aufgrund der erheblichen Gefährdung der im Haus schlafenden Personen und damit gerade ein bestimmendes Merkmal des Tatbestands zu Lasten des Angeklagten zu berücksichtigen, ist mit § 46 Abs. 3 StGB unvereinbar (vgl. BGH, Beschlüsse vom 13. April 2010 – 5 StR 113/10, NStZ 2010, 512 und vom 19. Mai 2010 – 5 StR 132/10, StraFo 2010, 429).

4 2. Hinsichtlich dieses Wertungsfehlers bedarf es nicht der Aufhebung von Feststellungen.
