The Federal Court rejected the defendant's revision against the LG Stralsund judgment. It held that the same omitted witness examination could be attacked both as a complaint concerning an evidentiary motion and as a duty-to-investigate complaint, although both complaints failed on the merits. The court also dismissed the objection based on the trial court's use of testimony from the defendant's father, explaining that the relevant passage contained only an obvious clerical error and that the context clearly showed which witness statements were meant. Costs were imposed on the defendant, including the adhered party's necessary expenses.
§ 344 Abs. 2 Satz 2 StPO; revision complaints and statement of grounds; the complainant determines the thrust of the complaint, but the same factual allegation may, if the pleaded facts so permit, be reviewed under several conceivable procedural defects. An obvious clerical error in the reasons for judgment does not constitute a review-relevant defect where the context unmistakably reveals the intended meaning. A revision is to be dismissed as unfounded under § 349 Abs. 2 StPO if no legal error to the defendant's detriment is disclosed.

Die Revision des Angeklagten gegen das Urteil des Landgerichts Stralsund vom 25. Februar 2015 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil des Angeklagten ergeben hat (§ 349 Abs. 2 StPO).
Der Beschwerdeführer hat die Kosten des Rechtsmittels und die dem Adhäsionskläger im Revisionsverfahren entstandenen notwendigen Auslagen zu tragen.
Ergänzend bemerkt der Senat:
Beide Rügen erweisen sich jedoch aus den vom Generalbundesanwalt dargelegten Gründen als jedenfalls unbegründet.
