The plaintiffs pursued appellate relief against judgments of the Hannover courts. The Federal Court of Justice, acting on the plaintiffs’ remedies, set aside the regional court judgment and amended the district court judgment by entering a new acknowledgment judgment. The defendant was ordered to pay each plaintiff EUR 400 with statutory default interest from 29 January 2013 and to indemnify them against pre-litigation legal costs of EUR 120.67. The defendant was also ordered to bear the costs of the proceedings.
ZPO; recognition judgment on appeal; where the respondent acknowledges the claim, the appellate court sets aside the challenged decisions and enters a new judgment in accordance with the acknowledgment, including ancillary claims such as interest and pre-litigation costs, and allocates costs against the acknowledging party.

Auf die Rechtsmittel der Kläger werden das Urteil der 6. Zivilkammer des Landgerichts Hannover vom 4. Juni 2014 aufgehoben und das Urteil des Amtsgerichts Hannover vom 3. Dezember 2013 abgeändert und wie folgt neu gefasst:
Die Beklagte wird verurteilt, an die Kläger jeweils 400 € nebst Zinsen in Höhe von 5 Prozentpunkten über dem Basiszinssatz seit dem 29. Januar 2013 zu zahlen und die Kläger von vorgerichtlichen Rechtsverfolgungskosten in Höhe von 120,67 € freizustellen.
Die Beklagte trägt die Kosten des Rechtsstreits.
