Tenor

Der Antrag des Antragstellers auf Bewilligung von Prozesskostenhilfe zur Durchführung des Nichtzulassungsbeschwerdeverfahrens unter Beiordnung des Rechtsanwalts beim Bundesgerichtshof Dr. N. wird zurückgewiesen.

Gründe

1 Der Prozesskostenhilfeantrag des Antragstellers ist abzulehnen, weil die beabsichtigte Rechtsverfolgung keine Aussicht auf Erfolg bietet (§ 114 Abs. 1 Satz 1 ZPO).

2 Die vom Antragsteller beabsichtigte Nichtzulassungsbeschwerde gegen die Nichtzulassung der Rechtsbeschwerde durch das Beschwerdegericht ist unzulässig. Der Nichtzulassungsbeschwerde unterliegt allein die Nichtzulassung der Revision durch das Berufungsgericht (§ 544 Abs. 1 Satz 1 ZPO), nicht aber die Nichtzulassung der Rechtsbeschwerde durch das Beschwerdegericht (BGH, Beschluss vom 10. Januar 2008 - IX ZB 109/07, WuM 2008, 113; Zöller/ Heßler, ZPO, 30. Aufl., § 574 Rn. 16). Die vorliegend getroffene Entscheidung des Beschwerdegerichts ist vielmehr unanfechtbar. Die gegen die Versagung von Prozesskostenhilfe durch das Beschwerdegericht gerichtete Rechtsbeschwerde findet nur statt, wenn sie im angefochtenen Beschluss zugelassen worden ist (§ 574 Abs. 1 Satz 1 Nr. 2 ZPO, § 577 Abs. 1 Satz 2 ZPO). Eine solche Zulassung ist hier nicht erfolgt.
