Omnilex-Zusammenfassung

In a complaint against the refusal to admit revision, the Federal Administrative Court held that the case raises a question of fundamental significance. It concerns whether flight procedures are unlawful if they do not allow the traffic volume envisaged by the planning approval decision to be handled within a foreseeable time, and whether municipalities or private noise-affected persons are thereby infringed in their rights. The court therefore set aside the non-admission decision and admitted revision. It also provisionally fixed the subject-matter value at EUR 580,000 and left the complaint costs to follow the costs in the main proceedings.

Omnilex-Regeste

§ 132 Abs. 2 Nr. 1 VwGO; leave to appeal for fundamental significance in proceedings concerning the fixation of flight procedures: Revision is to be admitted where the case is likely to clarify whether flight-procedure regulations are unlawful if they do not permit implementation of the traffic volume envisaged by the plan approval decision within a foreseeable period, and whether municipalities or private persons affected by aircraft noise are thereby infringed in their rights (consid. 1). The determination of the value in dispute for the revision proceedings is based on §§ 47, 52, 63 GKG.

Tenor
