Tenor

Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil der 65. Zivilkammer des Landgerichts Berlin vom 23. Juli 2014 wird auf ihre Kosten als unzulässig verworfen.

Der Antrag der Klägerin auf Beiordnung eines beim Bundesgerichtshof zugelassenen Rechtsanwalts wird zurückgewiesen.

Gründe

1 1. Die Nichtzulassungsbeschwerde ist unzulässig, weil der gemäß § 26 Nr. 8 EGZPO erforderliche Wert der geltend zu machenden Beschwer von mehr als 20.000 € nicht erreicht ist. Die der Klägerin durch die Abweisung ihrer Klage auf Räumung und Herausgabe der Mietwohnung entstandene Beschwer ist gemäß § 8 ZPO, § 9 ZPO analog mit dem dreieinhalbfachen Jahresbetrag der Nettomiete zu bewerten (vgl. Senatsbeschluss vom 8. April 2008 - VIII ZR 50/06, WuM 2008, 417 Rn. 2). Dieser beträgt hier (135 € x 42) 5.670 €.

2 Entgegen der Auffassung der Klägerin verletzt die Übergangsregelung des § 26 Nr. 8 EGZPO nicht das Rechtsstaatsprinzip, denn dieses gebietet nicht, dass in allen Fällen das Rechtsmittel der Revision gegeben sein muss (BGH, Beschluss vom 18. Dezember 2002 - IX ZA 31/02, NJW-RR 2003, 645 unter [II] 2 b mwN).

3 2. In Anbetracht der aufgezeigten Unzulässigkeit der Nichtzulassungsbeschwerde ist die Rechtsverfolgung der Klägerin aussichtslos, so dass ihr Antrag auf Beiordnung eines Notanwalts zurückzuweisen ist (§ 78b Abs. 1 ZPO).
