Die Beschwerde gegen die Nichtzulassung der Revision im Urteil des 2. Zivilsenats des Oberlandesgerichts Köln vom 27. November 2013 wird auf Kosten des Klägers zurückgewiesen.

Der Streitwert wird auf 6.524.493,52 € festgesetzt.

Gründe

1 Die Beschwerde deckt keinen Zulassungsgrund auf.

2 1. Der Kläger hat den ihm obliegenden Beweis, dass die Schuldnerin gegen einen Dritten gerichtete wertlose Forderungen getilgt und dadurch eine unentgeltliche Leistung erbracht hat (vgl. BGH, Urteil vom 30. März 2006 - IX ZR 84/05, WM 2006, 1156 Rn. 15), nicht geführt. Solange die zu Lasten der Schuldnerin ergangenen Umsatzsteuerbescheide bestehen, kann nicht davon ausgegangen werden, dass durch ihre an das Finanzamt bewirkten Zahlungen gegen einen Dritten gerichtete Umsatzsteuerverbindlichkeiten beglichen wurden.

3 2. Überdies scheidet eine unentgeltliche Leistung (§ 134 InsO) aus, weil die Schuldnerin annahm, durch ihre Zahlungen eigene Umsatzsteuerforderungen zu berichtigen. Eine Leistung ist nicht unentgeltlich, wenn der Schuldner zu der Leistung verpflichtet gewesen ist oder er wenigstens eine solche Verpflichtung angenommen hat (BGH, Urteil vom 13. März 1978 - VIII ZR 241/76, BGHZ 71, 61, 66; vom 29. November 1990 - IX ZR 29/90, BGHZ 113, 98, 103).
