Tenor

Die Revision des Angeklagten gegen das Urteil des Landgerichts Berlin vom 18. Juni 2013 wird mit der Feststellung nach § 349 Abs. 2 StPO als unbegründet verworfen, dass das Revisionsverfahren rechtsstaatswidrig verzögert worden ist (vgl. den Antrag des Generalbundesanwalts vom 1. September 2014).

Der Beschwerdeführer hat die Kosten des Rechtsmittels zu tragen.

Für die beantragte ergänzende Feststellung unangemessener Verfahrensdauer als Wiedergutmachung auf andere Weise bedarf es einer Verzögerungsrüge nicht (vgl. § 198 Abs. 4 Satz 1, 3 Halbsatz 2, § 199 Abs. 3 GVG). Ob eine solche für den Fall einer Kompensation im Sinne der Vollstreckungslösung (BGH, Beschluss vom 17. Januar 2008 - GSSt 1/07, BGHSt 52, 124) erforderlich wäre (vgl. einerseits Schäfer/Sander/van Gemmeren, Praxis der Strafzumessung, 5. Aufl., Rn. 792 ff., andererseits Graf, StPO, 2. Aufl., § 199 GVG Rn. 11 ff.; offen gelassen von BGH, Beschluss vom 5. Dezember 2012 - 1 StR 531/12, BGHR MRK Art. 6 Abs. 1 Satz 1 Verfahrensverzögerung 43), bedarf hier keiner Entscheidung, weil eine solche weitergehende Kompensation hier ohnehin nicht in Betracht kommt. Für die Feststellung der Verzögerung bedurfte es keiner Einstimmigkeit (vgl. BGH, Beschluss vom 24. Juli 2014 - 3 StR 176/14).
