The Federal Court dismissed the defendant’s revision against the Munich II Regional Court judgment. It held that the challenged refusal of evidence did not disclose a legal error because a lack of connexity does not render an evidence request inadmissible; rather, no evidence request exists in the procedural sense and the court must then examine the matter under the duty of ex officio investigation. The defendant was ordered to bear the costs of the remedy.
§ 244 Abs. 2, 3 StPO; lack of connexity of an evidentiary request: such a defect does not lead to inadmissibility of the request. Rather, if the asserted evidence and the requested fact are not sufficiently connected, no procedural evidentiary request exists; the trial court must then examine the motion solely under the duty of ex officio clarification. A refusal order mischaracterizing the request is not, for that reason alone, legally defective if the result is otherwise unobjectionable (cf. consid. 1).

Die Revision der Angeklagten gegen das Urteil des Landgerichts München II vom 12. Juni 2012 wird als unbegründet verworfen, da die Nachprüfung des Urteils auf Grund der Revisionsrechtfertigung keinen Rechtsfehler zum Nachteil der Angeklagten ergeben hat (§ 349 Abs. 2 StPO).
Die Beschwerdeführerin hat die Kosten des Rechtsmittels zu tragen.
Der Senat weist darauf hin, dass das im Ablehnungsbeschluss zutreffend beanstandete Fehlen der Konnexität nicht zur „Unzulässigkeit“ des Beweisantrags führt. Vielmehr liegt dann kein Beweisantrag vor, weshalb das Gericht seine Prüfung des Beweisbegehrens am Maßstab der Amtsaufklärungspflicht ausrichten muss (BGH, Beschluss vom 3. November 2010 - 1 StR 497/10, NJW 2011, 1239, 1240 f.; Urteile vom 8. Dezember 1993 - 3 StR 446/93, NJW 1994, 1294 und vom 28. November 1997 - 3 StR 114/97, NJW 1998, 1723, 1725).
