In a trademark appeal matter, the Federal Patent Court corrected a clerical mistake in a prior order. The decision date stated in the served order had been given as 30 May 2011, but the court clarified that the correct date was 30 May 2012. The correction was made under § 80(1) MarkenG. § 80 Abs. 1 MarkenG; correction of obvious clerical errors in a decision: where the wording of an order contains an incorrect date designation, the court may correct it ex officio or on application if the mistake is apparent from the record and concerns no substantive reconsideration. The correction serves solely to align the operative wording with the intended procedural act and does not affect the substantive content of the decision.

beschlossen:
Das in dem der Anmelderin am 11. Juni 2012 zugestellten Beschluss als Zeitpunkt der Entscheidung angegebene Datum 30. Mai 2011 wird dahingehend berichtigt, dass es richtig lauten muss 30. Mai 2012 (§ 80 Abs. 1 MarkenG).
