Tenor

Der Antrag des Klägers auf Zulassung der Berufung gegen das Urteil des Notarsenats des Oberlandesgerichts Celle (ohne Datum), ergangen nach Schriftsatzfrist bis 12. Mai 2011 im schriftlichen Verfahren, wird zurückgewiesen.

Der Kläger trägt die Kosten des Zulassungsverfahrens.

Der Streitwert wird auf 5.000 € festgesetzt.

Gründe

1 Ein Zulassungsgrund (§ 96 Abs. 1 Satz 1 BNotO, § 64 Abs. 2 BDG, § 124 Abs. 2 VwGO) ist nicht gegeben:

2 1. Ernstliche Zweifel an der Richtigkeit des angefochtenen Urteils (§ 124 Abs. 2 Nr. 1 VwGO) bestehen nicht. Zutreffend sieht das Oberlandesgericht einen den Verweis rechtfertigenden Verstoß gegen § 14 Abs. 1 und 3 BNotO darin, dass der Notar - ohne selbst mit Beurkundungen befasst gewesen zu sein - auf bloße Anforderung durch verschiedene Makler in sechs Fällen im automatisierten uneingeschränkten Abrufverfahren nach § 133 Abs. 2 GBO Grundbuchauszüge eingeholt hat, ohne vorab zu prüfen, ob die Makler von den jeweiligen Eigentümern entsprechend bevollmächtigt waren.

3 2. Auch der Zulassungsgrund der grundsätzlichen Bedeutung gemäß § 124 Abs. 2 Nr. 3 VwGO liegt nicht vor. Für die vom Kläger geltend gemachte Verfassungswidrigkeit des § 14 Abs. 3 BNotO gibt es keine Anhaltspunkte. Die grundsätzliche Frage, ob ein Notar - sofern eine Beauftragung durch den Eigentümer vorliegt und er eine solche - anders als hier - überprüft hat, stets auch im uneingeschränkten automatisierten Abrufverfahren tätig werden darf (vgl. Völzmann, DNotZ 2011, 164 ff.), war hier nicht entscheidungserheblich.

4 3. Die Kostenentscheidung beruht auf § 96 Abs. 1 Satz 1 BNotO, §§ 3, 77 Abs. 1 BDG, § 154 Abs. 2 VwGO; die Wertfestsetzung ist gemäß § 111g Abs. 1 Satz 1 BNotO i.V.m. § 52 Abs. 2 GKG erfolgt.
