The defendants 1 and 4 challenged the Federal Court of Justice’s prior judgment of 2011-06-01 by filing a hearing complaint, claiming a violation of the right to be heard. They argued that the court had failed to address an alleged rent reduction for September to December 2008 and the possibility of partial satisfaction from an excessive security deposit. The Federal Court of Justice held that the complaint was formally admissible under Section 321a ZPO but unfounded, because the contested submissions had been considered and were not decisive. The complaint was dismissed at the defendants’ cost.

A hearing complaint is unfounded if the court has in fact taken account of the allegedly overlooked submissions, even if it treats them as irrelevant to the outcome. II).

Revisionsverfahren vor dem BGH im Mietrechtsstreit: Unbegründete Anhörungsrüge
Die Anhörungsrüge der Beklagten zu 1 und 4 gegen das Senatsurteil vom 1. Juni 2011 wird auf ihre Kosten zurückgewiesen.
I.
1 Die Beklagten zu 1 und 4 wenden sich mit einem am 12. Juli 2011 eingegangenen Schriftsatz gegen das ihnen am 1. Juli 2011 zugestellte Senatsurteil vom 1. Juni 2011. Sie machen eine Verletzung ihres Anspruchs auf rechtliches Gehör geltend und beantragen, das Verfahren fortzusetzen.
2 Der Senat hat mit Urteil vom 1. Juni 2011 das Berufungsurteil aufgehoben und der Räumungsklage stattgegeben, weil die Klägerin angesichts der fortgesetzt unpünktlichen Mietzahlungen der Beklagten, die nach dem Mietvertrag eine monatliche Miete in Höhe von 1.440 € zu zahlen hatten, zur fristlosen Kündigung berechtigt war.
3 Die Beklagten zu 1 und 4 machen mit der Anhörungsrüge geltend, dass der Senat in diesem Zusammenhang weder eine vom Berufungsgericht für berechtigt erachtete Mietminderung in Höhe von monatlich 150 € in den Monaten September bis Dezember 2008 noch die Möglichkeit einer (teilweisen) Befriedigung aus der überhöhten Kaution erörtert habe.

4 Die nach § 321a ZPO statthafte Anhörungsrüge ist unbegründet. Der Senat hat das als übergangen gerügte Vorbringen gewürdigt, aber als – offensichtlich – nicht entscheidungserheblich erachtet.
