Anhörungsrüge: Anforderungen an die Darlegung der Gehörsverletzung

Tenor

Die Anhörungsrüge gegen das Senatsurteil vom 24. November 2010 wird auf Kosten der Beklagten als unzulässig verworfen.

Gründe

Die gemäß § 321a Abs. 1 ZPO statthafte und innerhalb der Frist des § 321a Abs. 2 Satz 1 ZPO eingelegte Anhörungsrüge ist unzulässig, weil sie das Vorliegen einer entscheidungserheblichen Verletzung des Anspruchs der Beklagten auf rechtliches Gehör nicht dargelegt hat (§ 321a Abs. 2 Satz 5 i.V.m. Abs. 1 Satz 1 Nr. 2 ZPO). Sie lässt insbesondere unberücksichtigt, dass der Senat in den Randnummern 11 bis 14 seines Urteils vom 24. November 2010, an die sich die von der Anhörungsrüge beanstandete Passage in Randnummer 15 anschließt, die Entscheidung selbständig tragend ausgeführt hat, dass die Klageansprüche (schon) im Hinblick auf die pharmakologische Wirkung des Präparats der Beklagten begründet sind.

2 II. Die Anhörungsrüge ist im Übrigen auch unbegründet. Der Senat hat in der Randnummer 15 seines Urteils vom 24. November 2010 insoweit von der Anhörungsrüge nicht zitiert im Einzelnen dargelegt, weshalb die vom Berufungsgericht getroffenen Feststellungen auch die Annahme einer metabolischen Wirkung des Präparats der Beklagten rechtfertigen.
