Der Antrag des Antragstellers, ihm für ein Rechtsmittel gegen den Beschluss des Hanseatischen Oberlandesgerichts Hamburg, 7. Zivilsenat, vom 3. August 2010 und das Schreiben der Vorsitzenden dieses Zivilsenats vom 23. September 2010 Prozesskostenhilfe zu gewähren, wird abgelehnt.

Gründe

1 Der Antrag auf Gewährung von Prozesskostenhilfe ist abzulehnen, weil die beabsichtigte Rechtsverfolgung keine hinreichende Aussicht auf Erfolg bietet (§ 114 Satz 1 ZPO). Die beabsichtigte „Ausnahmebeschwerde“ gegen den Beschluss vom 3. August 2010 und das Schreiben vom 23. September 2010 ist nicht statthaft. Nach der Neuregelung des Beschwerderechts durch das Zivilprozessreformgesetz kann der Bundesgerichtshof ausschließlich in den Fällen des § 574 Abs. 1 ZPO angerufen werden und ist eine außerordentliche Beschwerde wegen „greifbarer Gesetzeswidrigkeit" oder der Verletzung von Verfahrensgrundrechten nicht mehr statthaft (BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133, 135 ff.). Die Voraussetzungen des § 574 Abs. 1 ZPO liegen nicht vor. Die Rechtsbeschwerde ist weder nach dem Gesetz allgemein eröffnet (§ 574 Abs. 1 Satz 1 Nr. 1 ZPO) noch vom Beschwerdegericht im vorliegenden Fall zugelassen worden (§ 574 Abs. 1 Satz 1 Nr. 2 ZPO).
