Tenor

Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil des 4. Zivilsenats des Oberlandesgerichts Hamm vom 24. September 2009 wird zurückgewiesen, weil die Rechtssache weder grundsätzliche Bedeutung hat noch die Fortbildung des Rechts oder die Sicherung einer einheitlichen Rechtsprechung eine Entscheidung des Revisionsgerichts erfordert (§ 543 Abs. 2 S. 1 ZPO).

Das Berufungsgericht hat die Auffassung vertreten, das Feststellungsinteresse für die negative Feststellungsklage des Abgemahnten entfalle, wenn der Gegner in einem Verfahrensstadium, in dem das Feststellungsverfahren noch nicht entscheidungsreif ist, Leistungsklage erhebt und auf sein Recht zur Klagerücknahme mit der Folge verzichtet, dass die Leistungsklage nicht mehr einseitig zurückgenommen werden kann. Dies entspricht der einhelligen Auffassung im Schrifttum (vgl. Keller, WRP 2000, 908, 911 f.; Harte/Henning/Brüning, UWG, 2. Aufl., Vorb zu § 12 Rdn. 126; Köhler in Köhler/Bornkamm, UWG, 28. Aufl., § 12 Rdn. 2.20; MünchKomm.UWG/Ehricke, vor § 12 Rdn. 29; Teplitzky, Wettbewerbsrechtliche Ansprüche und Verfahren, 9. Aufl., Kap. 41 Rdn. 70 und Kap. 52 Rdn. 20) und lässt keinen Rechtsfehler erkennen.

Von einer näheren Begründung wird gemäß § 544 Abs. 4 Satz 2, 2. Halbs. ZPO abgesehen.

Die Klägerin trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
