Tenor

  1. Auf die Revisionen der Angeklagten wird das Urteil des Landgerichts Dessau-Roßlau vom 28. Oktober 2009 aufgehoben,

a) soweit die Angeklagten im Fall II. 16. der Urteilsgründe verurteilt worden sind,

b) in den Aussprüchen über die Gesamtstrafen.

  1. Im Umfang der Aufhebung wird die Sache zu neuer Verhandlung und Entscheidung, auch über die Kosten der Rechtsmittel, an eine andere Jugendkammer des Landgerichts zurückverwiesen.

  2. Die weiter gehenden Revisionen werden verworfen.

Gründe

1 Das Landgericht hat den Angeklagten H. wegen unerlaubten Handeltreibens mit Betäubungsmitteln in nicht geringer Menge, [gewerbsmäßigen] unerlaubten Handeltreibens mit Betäubungsmitteln, unerlaubter Abgabe von Betäubungsmitteln als Person über 21 Jahre an eine Person unter 18 Jahren in 14 Fällen sowie unerlaubter Abgabe von Betäubungsmitteln zu einer Gesamtfreiheitsstrafe von vier Jahren und sechs Monaten verurteilt, den Angeklagten R. wegen Beihilfe zum unerlaubten Handeltreiben mit Betäubungsmitteln in nicht geringer Menge und Beihilfe zum unerlaubten Handeltreiben mit Betäubungsmitteln zu einer Gesamtfreiheitsstrafe von zwei Jahren. Gegen dieses Urteil wenden sich die Angeklagten mit ihren auf Sachrügen gestützten Revisionen, der Angeklagte H. erhebt darüber hinaus auch eine Verfahrensrüge.

2 Die Rechtsmittel haben mit den Sachrügen in dem aus der Beschlussformel ersichtlichen Umfang Erfolg; im Übrigen sind sie unbegründet im Sinne des § 349 Abs. 2 StPO.

3 1. Die Verurteilungen der Angeklagten im Fall II. 16. der Urteilsgründe wegen unerlaubten Handeltreibens mit Betäubungsmitteln (H.) bzw. Beihilfe zum unerlaubten Handeltreiben mit Betäubungsmitteln (R.) halten revisionsrechtlicher Prüfung nicht stand, weil die Feststellungen insoweit lückenhaft sind. Das angefochtene Urteil enthält keine Angaben zur Art und Menge der Betäubungsmittel, die der Angeklagte H. zum Zweck gewinnbringenden Weiterverkaufs erworben und der - eingeweihte - Angeklagte R. für ihn aufbewahrt hat. In den Urteilsgründen wird lediglich mitgeteilt, dass es in diesem Fall "um eine nicht bekannte Menge von Betäubungsmitteln" (UA 9) ging. Hierzu wird der neue Tatrichter nähere Feststellungen zu treffen haben.

4 2. Die Aufhebung der Schuldsprüche in diesem Fall zieht auch die Aufhebung der Gesamtstrafen nach sich.

5 3. Soweit das Landgericht gegen den Angeklagten H. in den Fällen II. 1. bis 15. der Urteilsgründe Geldstrafen verhängt hat, enthält das Urteil keine Angabe der Tagessatzhöhe. Der Festsetzung der Tagessatzhöhe bedarf es auch dann, wenn - wie hier - aus Einzelgeldstrafen und Freiheitsstrafen eine Gesamtfreiheitsstrafe gebildet wird (vgl. BGHSt 30, 93, 96 f.; BGH, Urt. vom 28. Oktober 1987 - 3 StR 381/87, BGHR StGB § 54 Abs. 3 Tagessatzhöhe 1; vgl. auch Fischer StGB 57. Aufl. § 40 Rdn. 6 m.w.N.). Der Senat holt dies - in entsprechender Anwendung von § 354 Abs. 1 StPO - nach und setzt die Tagessatzhöhe auf den Mindestsatz von einem Euro (§ 40 Abs. 2 Satz 3 StPO) fest.

Soweit der Generalbundesanwalt in seiner Antragsschrift beanstandet, das Urteil erschöpfe den Eröffnungsbeschluss nicht, weil dem Angeklagten H. in der zugelassenen Anklageschrift 120 Fälle der unerlaubten Abgabe von Betäubungsmitteln an die Zeugin S. zur Last gelegt waren, er aber nur in 13 Fällen (Fälle II. 1. bis 13. der Urteilsgründe) deswegen verurteilt worden ist, ist dem Senat eine Entscheidung dazu verwehrt, weil das Verfahren insoweit nicht hier, sondern noch beim Landgericht anhängig ist (vgl. BGH, Beschlüsse vom 11. November 1993 - 4 StR 629/93, BGHR StPO § 352 Abs. 1 Prüfungsumfang 4, und vom 18. April 2007 - 2 StR 144/07, NStZ 2007, 476; vgl. auch Meyer-Goßner StPO 52. Aufl. § 352 Rdn. 1).
