The Senate held that no existing case law of the Senate precluded this result and stated that it would not adhere to any contrary authority. Whether the solution rests exclusively on a normative hierarchy or also on concurrence considerations was left open (consid. 10 ff. of the referring decision).

Tenor

Der beabsichtigten Entscheidung steht, soweit ersichtlich, Rechtsprechung des Senats nicht entgegen. An möglicherweise entgegenstehender Rechtsprechung würde der Senat nicht festhalten.

Der Senat tritt den Erwägungen des anfragenden Senats in Rdn. 10 ff. des Beschlusses vom 13. Januar 2010 jedenfalls im Ergebnis bei. Ob die Begründung für eine (eindeutige) Verurteilung wegen Nichtanzeige geplanter Straftaten gemäß § 138 StGB trotz fortbestehenden Tatverdachts einer Beteiligung an der geplanten Katalogtat (allein) auf die Annahme eines normativen Stufenverhältnisses oder (auch) auf konkurrenzrechtliche Überlegungen zu stützen ist, kann hierbei offen bleiben.
