Voraussetzungen für eine Zulassung der Revision: Zulassungsgründe für eine Klärung des Gerichtsstands bei Haustürgeschäften und des Gerichtsstands des Erfüllungsorts

Tenor

Die Revision des Klägers gegen das Urteil des 25. Zivilsenats des Oberlandesgerichts München vom 30. Januar 2009 wird zurückgewiesen.

Der Kläger hat die Kosten des Revisionsverfahrens zu tragen.

Streitwert: 516.882,35 €

Gründe

1 Die Revision ist gemäß § 552a ZPO durch Beschluss zurückzuweisen, weil die Voraussetzungen für die Zulassung der Revision nicht vorliegen (§ 543 Abs. 2 Satz 1 ZPO) und das Rechtsmittel darüber hinaus keine Aussicht auf Erfolg bietet. Zur Begründung wird auf den Beschluss vom 18. November 2009 Bezug genommen (§ 552a Satz 2, § 522 Abs. 2 Satz 2 und 3 ZPO).

2 Der Schriftsatz des Klägervertreters vom 26. Januar 2010 vermag keine - weiteren - Zulassungsgründe aufzuzeigen. Ergänzend weist der Senat noch auf Folgendes hin:

3 Die Annahme des Berufungsgerichts, dass der Zessionar sich nicht auf den Gerichtsstand des § 29c ZPO berufen könne, steht im Einklang mit dessen Schutzzweck. Der Unternehmer soll durch § 29c ZPO benachteiligt werden, weil er am Wohnsitz des Verbrauchers die Initiative zum Vertragsschluss ergriffen hat (vgl. BGH, Beschluss vom 7. Januar 2003 - X ARZ 362/02 - NJW 2003, 1190 unter III 1); dieser Gedanke greift im Verhältnis zum Zessionar gerade nicht. Durch die Abtretung wird - vom Verbraucher veranlasst - eine neue Situation geschaffen.

4 Auf die Ausführungen zur Verordnung (EG) Nr. 44/2001 des Rates über die gerichtliche Zuständigkeit und die Anerkennung und Vollstreckung von Entscheidungen in Zivil- und Handelssachen vom 22. Dezember 2000 (EuGVVO) kommt es hier nicht an, da deren Anwendungsbereich nach den von der Revision nicht hinreichend angegriffenen Feststellungen des Berufungsgerichts nicht eröffnet ist.

5 Eine Zuständigkeit nach § 29 ZPO für Schadensersatzansprüche aus Verschulden bei Vertragsverhandlungen vermag der Kläger weiterhin nicht aufzuzeigen. Soweit hierbei Bezug auf einen selbstständigen Beratungs- und Auskunftsvertrag oder eine deliktische Haftung genommen wird, hat das Berufungsgericht aus tatsächlichen Gründen zutreffend eine Zuständigkeit nach §§ 29, 32 ZPO verneint.
