Tenor

I.

Der Verhandlungstermin vom 17.12.2013 entfällt.

II.

Gemäß § 278 Abs. 6 ZPO wird folgender Vergleich festgestellt:

  1. Die Klägerin verzichtet auf die streitbefangene Forderung und erklärt Klageverzicht.
  2. Die Klägerin übernimmt die Kosten des Verfahrens, Kosten des Vergleichs werden gegeneinander aufgehoben.
  3. Die Vereinbarung ist präjudiziell.
  4. Die Parteien vereinbaren Stillschweigen über das streitgegenständliche Verfahren und den Inhalt dieses Vergleiches. Der Beklagte verpflichtet sich auch gegenüber der Q GmbH zu Stillschweigen über das Verfahren und über den Inhalt des Vergleichs.
  5. Damit sind sämtliche streitgegenständliche Ansprüche sowie auch eventuelle Produkthaftungsansprüche gegen den Hersteller erledigt. Der Beklagte verzichtet insbesondere auch gegenüber der Q und mit ihr nach §§ 15 ff. AktG verbundenen Gesellschaften auf eventuelle Ansprüche aus dem streitgegenständlichen Sachverhalt.

III.

Der Streitwert für den Rechtsstreit und den Vergleich wird festgesetzt auf

4.842,11 €.
